(hereinafter, the DATA CONTROLLER), is the Data Controller for the processing of the User's personal data and informs you that this data will be processed in accordance with the provisions of Regulation (EU) 2016/679, of April 27 (GDPR), and Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights (LOPDGDD).

Purpose of the processing

To manage the informational and commercial relationship with users interested in our B2C product catalogue through the mmrbikes.com platform. The operations planned to carry out the processing are:

  • Response to queries and requests: Provide answers to information requests, doubts, or applications sent by users through the contact forms on the website.

  • Commercial advertising communications: Sending newsletters and offers about our cycling products, news, and accessories by email or other electronic means.

  • Statistical studies and optimization: Conduct analysis of web traffic, browsing behavior, and performance of advertising campaigns to optimize the operation of the platform and our product catalogue.

Legal basis of the processing

The sending of commercial communications, the use of contact forms, and the collection of analytical or advertising browsing data are based on the express consent requested from you by checking the corresponding box on the forms or by accepting the cookie banner (Art. 6.1.a GDPR). Data processing for aggregated internal statistical analysis is based on the legitimate interest of the data controller (Art. 6.1.f GDPR) to improve the technical quality of the services.

Data retention criteria

Data will be retained as long as there is a mutual interest in maintaining the purpose of the processing or as long as there are legal retention obligations. In the case of consultation forms, they will be deleted once the request is resolved; in the case of the Newsletter, they will be kept until the user withdraws their consent. When it is no longer necessary for such purposes, it will be deleted using appropriate security measures to guarantee the pseudonymization of the data or its total destruction.

Communication and transfer of data

The data will not be transferred to third parties for their own commercial purposes, except under legal obligation. However, for the technical, analytical, and advertising management of the digital catalogue, access to the data is permitted to the following technology providers in their capacity as data processors or co-controllers:

  • Google LLC: For statistical and traffic analysis of the website through Google Analytics.

  • Meta Platforms Ireland Ltd.: For conversion tracking and optimization of advertising campaigns through the Meta Ads Pixel.

  • Microsoft Ireland Operations Ltd.: For visual analysis of user behavior and heat maps through Microsoft Clarity.

  • Mailchimp / Rocket Science Group LLC: For the automation and sending of our electronic commercial communications.

International Transfers: The use of the tools from the indicated providers implies the international transfer of personal data to the United States. These transfers are fully regularized and guarantee a level of protection equivalent to the European one since they are carried out under the EU-U.S. Data Privacy Framework and, complementarily, through the signing of the Standard Contractual Clauses (SCC) approved by the European Commission.

User Rights

  • Right to withdraw consent at any time.

  • Right of access, rectification, portability, and erasure of your data, and to the restriction or opposition to its processing.

  • Right to lodge a complaint with the Supervisory Authority in Spain (Agencia Española de Protección de Datos – aepd.es) if you consider that the processing does not comply with current regulations.

Users, by checking the corresponding boxes and entering data into the fields marked with an asterisk (*) in the contact, subscription, or download forms, expressly, freely, and unequivocally accept that their data are necessary for the provider to meet their request, the inclusion of data in the remaining fields being voluntary.

The User guarantees that the personal data provided are true and is responsible for communicating any modification thereof. All data requested through the website with an asterisk are mandatory, as they are necessary for the provision of an optimal service. If they are not provided, it cannot be guaranteed that the information and commercial services offered will completely match your information needs.

3. SECURITY MEASURES

In accordance with the provisions of current regulations on personal data protection, the DATA CONTROLLER is complying with all provisions of the GDPR and the LOPDGDD, and manifestly with the principles described in Article 5 of the GDPR. The data are processed in a lawful, fair, and transparent manner in relation to the data subject, and are adequate, relevant, and limited to what is necessary.

The DATA CONTROLLER guarantees that it has implemented appropriate technical and organizational policies (including HTTPS/SSL secure encryption protocols) to apply the security measures established by the GDPR and the LOPDGDD in order to protect the rights and freedoms of the Users and to prevent any alteration, loss, or unauthorized access to data in the digital environment.
